All customer orders are taken in good faith and once placed are binding. No changes can be accepted after fish has been prepared for despatch or, for special orders, after fish has been purchased to fulfil the order.

Availability / Quality:

We reserve the right not to fulfil orders where the specific product is unavailable due to seasonality, market availability or quality once our fishmongers have assessed the landed catch. Where possible we will contact you to advise you of any shortages before despatch and to offer any available alternatives.

Title of Goods:

The goods remain the property of Wing of St Mawes Ltd until they are paid for in full, and the company reserves the right to enter the premises in order to reclaim any goods against overdue invoices.

Pricing:

The supply of goods is subject to availability and price ruling at time of invoice. Prices quoted are exclusive of VAT where applicable which will be charged at the prevailing rate.

Delivery:

Delivery of goods will be made by our own fleet of vehicles or by courier. For courier deliveries, we send everything as next-day delivery. However we cannot guarantee this delivery as this is reliant on the courier and may take place the following day. All our seafood is packed to say fresh and cold in transit for up to 72 hours.

Returns / Damages / Short deliveries:

All goods must be checked by the customer at time of delivery or within 24 hours if this is not practical. Any discrepancies must be notified to the company within 24 hours of delivery. As a general rule, the company is unable to accept returns from deliveries fulfilled by our third party couriers. Any damages or returns must be held in good order awaiting the Company’s instructions. For goods that have been held we will require documented proof that the “Chill Chain” has been maintained.

Credit Accounts:

New customers are required to pay on a “Per Order” basis (see above) until the account has been authorised for credit. The company can, in it’s absolute discretion, refuse any application for a credit account, or vary the terms requested.

We reserve the right to change or supplement these terms and conditions from time to time by posting updated version on our website and, by continuing to place orders though Wing of St Mawes Ltd after such changes have been made, you will be bound by such changes or supplements even if you do not obtain an updated copy of this document. If we fail to enforce a right under this agreement, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.

This agreement shall be governed by the laws of England and the Company and the Customer agree to submit to the exclusive jurisdiction of the English Courts.
